Student Hub Terms and Conditions

1. About these Terms

These Student Hub Terms and Conditions (“Hub Terms”) govern your access to and use of the Student Hub, the online student portal made available by The English Kit (ABN 71 285 091 173) (“we”, “us”, “our”) to enrolled students (the “Hub”).

The Hub is an additional, subscription-based service on top of The English Kit’s tutoring services. These Hub Terms apply in addition to our general Website Terms and Conditions and our Privacy Policy. If there is a conflict between these Hub Terms and the general Website Terms and Conditions in relation to your use of the Hub, these Hub Terms take priority.

These Hub Terms incorporate by reference, and should be read together with, our Student Hub Acceptable Use Policy, which forms part of the terms governing your use of the Hub.

By creating a Hub account, or by accessing or using any part of the Hub, you (or, where you are under 18, your parent or guardian on your behalf) agree to be bound by these Hub Terms and our Privacy Policy. If you do not agree, you must not use the Hub.

2. Definitions

  • “Hub” means the Student Hub portal and all of its sections described above.
  • “Account” or “Your Profile” means your registered login and the personal details associated with it.
  • “Our Materials” means content we make available on the Hub, including lesson videos, masterclasses, live sessions, text guides, marking rubrics, sample and model responses, prompts, roadmap tasks and the Auto-Marker tool itself.
  • “Your Content” or “Your Submissions” means essays, drafts, files, images (including handwriting photos), messages, discussion posts, comments, profile information and any other material you submit, upload or post to the Hub.
  • “Auto-Marker” means the proprietary AI-assisted essay marking and feedback tool developed by The English Kit, available within Essays & Feedback and the free tools area.
  • “Community” means the discussion board, weekly practice prompts, publications library and study group areas of the Hub.
  • “Messages” means the internal messaging platform between students and their tutor(s)/adviser(s).
  • “Guardian” means a parent or guardian linked to a student’s account with read-only guardian access.
  • “Subscription” means the paid plan required to access the Hub, processed through our payment provider (currently Stripe).

3. Eligibility, Accounts and Minors

The Hub is intended for students currently enrolled with The English Kit, many of whom are under 18 years of age. Where a student is under 18, a parent or guardian must consent to these Hub Terms on the student’s behalf, and is responsible for approving the creation of the student’s account.

You must keep your login details confidential and notify us immediately if you become aware of any unauthorised access to your account.

A guardian may be linked to a student’s account to receive a separate, read-only guardian view (see clause 11). Only one Hub account may be created per student.

We may verify your eligibility (including that you hold an active Subscription) at any time before granting or continuing to provide access to the Hub.

4. Subscription, Billing and Access

Access to the Hub requires an active, or in-grace, paid Subscription.

We may restrict or suspend your access to the Hub if your Subscription lapses, is cancelled, or a payment fails, subject to any grace period we apply.

If you cancel your Subscription, your access to Hub features will end at the conclusion of your current billing period unless we tell you otherwise. We will give you reasonable notice, and a reasonable opportunity to request a copy of Your Submissions, before permanently deleting your Hub data.

We may change our Subscription fees or plans from time to time. We will give you reasonable notice of any price change before it takes effect for you.

5. Licence to Use Our Materials

Our Materials are owned by us or licensed to us and are protected by copyright and other intellectual property laws. Subject to these Hub Terms and to you holding an active Subscription, we grant you a personal, non-exclusive, non-transferable and revocable licence to access and use Our Materials solely for your own individual study.

You must not, and must not permit or assist anyone else to:

  • copy, reproduce, republish, download for redistribution, distribute, sell, rent, sub-license or otherwise share Our Materials;
  • screen-record, re-upload, publicly perform, broadcast or livestream any lesson video, masterclass or live session to any person outside your own account;
  • remove, obscure or alter any copyright, trade mark or other proprietary notice on Our Materials;
  • use Our Materials to create a competing product, service or tutoring resource; or
  • allow any person other than you (or, for a linked guardian, in accordance with the guardian view in clause 11) to access your account or Our Materials.

This licence ends immediately when your access to the Hub ends, including on cancellation, suspension or termination of your Subscription or account. “The English Kit” name, logo and other trade marks remain our property at all times.

6. Your Content — Essays, Drafts and Submissions

You retain ownership of the essays, drafts and other original work you submit to the Hub (“Your Submissions”). We do not claim ownership of Your Submissions.

By submitting content to the Hub, you grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce and use Your Submissions to:

  • provide our tutoring, marking and feedback services to you, including through the Auto-Marker and our human tutors;
  • track and display your own progress to you (and, where applicable, your linked guardian, in accordance with clause 11); and
  • maintain, secure and improve the Hub and our services.

Your Submissions, and any feedback on them, are treated as private between you, your tutor(s) and (in relation to progress summaries only) your linked guardian. We will not make Your Submissions visible to other students, other tutors’ students, or the wider Community, and will not publish them anywhere on the Hub or our website, unless you give specific consent under clause 7.

You warrant that Your Submissions are your own original work and do not infringe the rights of any other person.

7. Consent to Feature Content in the Community

Nothing you submit to the Hub is shared with other students, published in the Community, or featured as a model response unless you (or, where you are under 18, your parent or guardian) give us consent to do so. Consent under this clause is separate from, and in addition to, the licence in clause 6.

This clause applies to content that may be shared more widely within the Hub, including:

  • posts, comments and replies you choose to publish on the discussion board;
  • responses you submit to a weekly practice prompt that you choose to share as a model response;
  • essays or extracts you agree to have featured in the publications library; and
  • any other content you choose to post in the Community or a study group.

Where you give consent, you may choose (subject to what the Hub interface allows at the time) whether your first name is shown or your content is shared anonymously. We may also invite you to have an outstanding essay featured as a model response; we will only do so with your (or your guardian’s) prior consent.

8. Community and Messages

The Community (discussion board, weekly prompts, publications library and study group) is for discussion, shared learning and peer support relating to VCE English study. Messages is for direct communication between you and your own tutor/adviser about your tutoring, feedback and scheduling.

When using the Community or Messages, you must not post, send or share content that:

  • is unlawful, or promotes or facilitates unlawful activity;
  • is offensive, obscene, defamatory, discriminatory or hateful;
  • bullies, harasses, threatens or demeans any person;
  • contains another person’s personal information without their consent; or
  • infringes the intellectual property or other rights of any person.

We reserve the right to suspend or restrict your access to the Hub, in accordance with clause 13 (Suspension and Termination), if you post, send or share any such content.

A “tutor-verified” or “pinned” marker on a Community post indicates that a tutor has reviewed or endorsed that post; it is not a guarantee of accuracy for exam purposes, and should not be treated as a substitute for advice specific to your own study.

We and our tutors may monitor, moderate, edit or remove Community content, and may review Messages, where reasonably necessary for safety, to enforce our policies, to respond to a report, or as required by law. Because many Hub users are minors, you should not expect Messages to be treated as a fully private channel in the way a personal messaging app might be.

9. Essay Marking — Human Tutors and the Auto-Marker

You can receive feedback on your writing in two ways: (a) marking and feedback from a human tutor, and (b) the Auto-Marker, our AI-assisted marking tool.

In relation to the Auto-Marker, you acknowledge and agree that:

  • it produces an AI-generated assessment against VCE-style marking rubrics, intended as a study aid and indicative feedback only;
  • it is not a guarantee or prediction of any VCE study score, examination result or ATAR, is not an official VCAA assessment, and is not a substitute for feedback from a human tutor;
  • like any AI tool, it may occasionally produce inaccurate, incomplete or inconsistent feedback, and you should use your judgment (and your tutor’s guidance) when relying on it; and
  • to provide the Auto-Marker and related tools (including transcription of handwriting photos), we may process your submission using third-party AI service providers, in accordance with our Privacy Policy.

You must only submit your own work, or work you otherwise have the right to submit, to the Auto-Marker.

We may retain a record of your Auto-Marker run history so it can be shown on your own dashboard, and to help us monitor and improve the quality of the tool.

10. My Lessons, My Roadmap and the Tutor View

Roadmap tasks are set by your tutor or adviser to help guide your study. They are a study planning tool and are not a guarantee of any particular outcome.

My Lessons gives you access to a video library, masterclasses and live sessions for your own personal educational use, subject to the licence in clause 5.

Where a tutor or adviser uses the Hub’s tutor-facing views to manage their students (for example, to assign lessons, review essays, or message students), they must only access student information for legitimate tutoring purposes, keep it confidential, and must not share a student’s essays, messages or personal information outside the Hub without proper authorisation.

11. Guardian Access

A parent or guardian of a student under 18 may be linked to the student’s account to receive a separate, read-only guardian view.

The guardian view is limited to:

  • a read-only progress summary;
  • billing and invoices;
  • attendance and session information; and
  • a contact-the-tutor form.

Guardians cannot view a student’s essays or other Submissions, private Messages, or Community activity. This content remains within the student’s own control, consistent with clauses 6 and 7. Linking a guardian to a student’s account requires the identity verification and invitation process we specify from time to time.

12. Account Security

You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. You must notify us immediately at hello@theenglishkit.com.au if you become aware of any unauthorised access to, or use of, your account.

We may suspend an account we reasonably believe has been compromised or is being misused, in order to protect you and other users.

13. Suspension and Termination

We may suspend, restrict or terminate your access to the Hub, with reasonable notice where practicable, if:

  • you breach these Hub Terms;
  • your Subscription lapses, is cancelled, or payment fails, beyond any applicable grace period; or
  • we reasonably believe it necessary to protect the safety, rights or property of you, another user, or us.

We may act immediately and without prior notice where we reasonably consider there to be a serious breach or a safety concern, particularly one involving a minor.

On termination of your access, these Hub Terms will continue to apply to the extent needed to give effect to provisions which by their nature survive termination, including those relating to intellectual property, the licence to Your Content, confidentiality, disclaimers, liability and indemnity.

14. Disclaimers

The Hub, Our Materials, Auto-Marker feedback and human tutor feedback are provided for educational purposes and as general study guidance. They do not guarantee any particular VCE result, study score or ATAR, and are not a substitute for your own judgment, further study, or advice from your school.

To the maximum extent permitted by law, we exclude all warranties as to the accuracy, completeness or reliability of feedback generated by the Auto-Marker or provided by a tutor.

Nothing in these Hub Terms is intended to exclude, restrict or modify any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

15. Indemnity

You agree to indemnify us against any claim, loss, damage, cost or expense (including reasonable legal costs) arising from your breach of these Hub Terms, your misuse of the Hub, or Your Content infringing the rights of any other person, except to the extent caused by our own breach or negligence.

16. Relationship to Our Other Policies

These Hub Terms incorporate, by reference, our Privacy Policy, which applies to your use of the Hub. Your use of the rest of our website continues to be governed by our general Website Terms and Conditions.

17. Changes to These Hub Terms

We may update these Hub Terms from time to time. We will notify you of material changes through the Hub or by email. Your continued use of the Hub after a change takes effect means you accept the updated Hub Terms.

18. Governing Law

These Hub Terms are governed by the laws of Victoria, Australia, and are to be read together with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Each party submits to the non-exclusive jurisdiction of the courts of Victoria.
